Affiliate Programme Terms

These terms govern your participation in the Domkop AI Affiliate Programme, operated by Creative Crew Studio Ltd (Company No. NI696783). By joining the programme, you agree to these terms in addition to our Terms of Service.

1. Eligibility

• You must be 18 years or older
• You must have an active Domkop AI account
• You must provide accurate personal and payment information
• You must comply with all applicable laws in your jurisdiction, including advertising and disclosure requirements

We reserve the right to accept or reject any affiliate application at our sole discretion.

2. Commission Structure

Affiliates earn a percentage commission on qualifying subscription payments made by users who sign up through their unique referral link. Commission tiers are based on performance:

Commission rates are subject to override caps as determined by us. We reserve the right to adjust commission rates with 30 days' notice.

3. Qualifying Transactions

• Commissions are earned on recurring subscription payments (Starter, Pro, and Business tiers) made by referred users
• Commissions are not earned on credit top-up purchases
• Commissions are not earned on free tier accounts
• Self-referrals are not permitted

4. Payment Terms

• Commissions are calculated monthly based on confirmed payments
• Payments are made via EFT (Electronic Funds Transfer) to the bank account you provide
• Minimum payout threshold: R250. If your balance is below R250, it carries over to the next month
• Payments are processed on a monthly cycle
• You are responsible for declaring affiliate income to your local tax authority

5. Prohibited Practices

As an affiliate, you must not:

• Spam — send unsolicited bulk emails, SMS messages, or social media messages promoting Domkop AI
• Make misleading claims — exaggerate features, fabricate testimonials, guarantee specific outcomes, or make income claims
• Bid on our brand terms — use "Domkop", "Domkop AI", or related terms in paid search advertising
• Engage in cookie stuffing — force referral tracking through deceptive means
• Create fake accounts — register multiple accounts or make fraudulent purchases to earn commissions
• Use deceptive redirects — disguise affiliate links in a misleading way
• Violate any law — including consumer protection, privacy, and advertising standards regulations

6. Disclosure Requirements

You must clearly and conspicuously disclose your affiliate relationship with Domkop AI in all promotional content. This is a legal requirement under advertising standards regulations in South Africa (ASA Code) and the UK (ASA/CAP Code).

Examples of acceptable disclosures include: "Affiliate link", "I earn a commission if you sign up through this link", or "#ad #affiliate".

7. Fraud and Clawback

We monitor affiliate activity for fraud. If we determine that commissions were earned through fraudulent, deceptive, or policy-violating means, we reserve the right to:

• Withhold pending commission payments
• Claw back commissions already paid
• Suspend or terminate your affiliate account
• Pursue legal remedies as appropriate

Commissions associated with chargebacks, refunds, or cancelled subscriptions within the cooling-off period will be reversed.

8. Termination

Either party may terminate the affiliate relationship at any time with written notice. Upon termination:

• You must immediately cease all promotional activity
• You must remove all affiliate links and Domkop AI promotional materials
• Earned commissions above the minimum payout threshold will be paid in the next payment cycle
• Commissions below the minimum threshold are forfeited upon termination

9. Intellectual Property

We grant you a limited, non-exclusive, revocable licence to use the Domkop AI name and logo solely for the purpose of promoting the Service as an affiliate. You must not modify our branding or use it in a way that suggests endorsement beyond the affiliate relationship.

10. Liability

We are not liable for any losses you incur in connection with your affiliate activities. The affiliate programme is provided "as is" without warranties regarding commission amounts, referral conversion rates, or programme continuity.

11. Changes to These Terms

We may update these Affiliate Programme Terms at any time. We will notify active affiliates of material changes by email. Continued participation after changes take effect constitutes acceptance.
