Terms of Service

1. Acceptance of Terms

By accessing or using Domkop AI at app.domkopai.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

These Terms form a legally binding agreement between you and Creative Crew Studio Ltd(Company No. NI696783), registered at 55 Kensington Road, Belfast, United Kingdom, BT5 6NL ("we", "us", "our").

2. ECT Act Section 43 Disclosures

In compliance with section 43 of the South African Electronic Communications and Transactions Act 25 of 2002 (ECT Act):

3. Service Description

Domkop AI is an AI-powered chatbot SaaS application that provides conversational AI assistance. The Service uses third-party AI models including Google Gemini, Anthropic Claude, and Google Cloud Text-to-Speech.

We operate a credit-based system. Different features consume between 1 and 15 credits per use. Credits are allocated monthly with your subscription tier and can be supplemented with top-up bundles.

4. Eligibility

You must be at least 18 years old to create an account and use the Service independently. Persons aged 13 to 17 may use the Service only with verifiable consent from a parent or legal guardian. If you are under 13, you may not use the Service.

5. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate, current, and complete information during registration. You must notify us immediately of any unauthorised use of your account.

6. Subscriptions and Billing

Domkop AI offers the following subscription tiers:

  • Free — R0/month
  • Starter — R79/month
  • Pro — R159/month
  • Business — R299/month

Additional credit top-up bundles are available from R9. Payments are processed via Stripe in ZAR for South African users and GBP for international users.

Auto-renewal

Paid subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. In terms of the Consumer Protection Act 68 of 2008 (CPA), we will notify you before any renewal where there has been a change to the subscription price.

7. Cooling-off Period

In terms of section 44 of the ECT Act, you have the right to cancel your subscription within 7 days of your initial purchase without reason and receive a full refund. To exercise this right, email us at info@creativecrewstudio.co.uk. See our Refund & Cancellation Policy for full details.

8. AI Disclaimer

Domkop AI is an AI assistant provided for informational and entertainment purposes only.

  • AI-generated content is not professional advice. It should not be relied upon as legal, medical, financial, tax, or any other form of professional advice.
  • AI models can produce inaccurate, incomplete, or misleading information ("hallucinations"). Always verify important information independently.
  • You use AI-generated content entirely at your own risk.
  • We do not guarantee the accuracy, reliability, or completeness of any AI output.

9. Content Ownership

You retain ownership of the content you input into the Service ("Your Content"). You grant us a limited, non-exclusive licence to process Your Content solely for the purpose of providing the Service.

AI-generated outputs are provided to you for your use. We do not claim ownership of AI-generated content. However, the same or similar outputs may be generated for other users.

10. Acceptable Use

Your use of the Service must comply with our Acceptable Use Policy. We reserve the right to suspend or terminate accounts that violate these rules.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total aggregate liability for any claims arising from your use of the Service shall not exceed the total fees you paid to us in the 12 months preceding the claim.
  • Nothing in these Terms limits or excludes our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Creative Crew Studio Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

You may close your account at any time through the in-app settings or by emailing us. We may suspend or terminate your access to the Service if you breach these Terms, engage in prohibited activities, or if required by law.

Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

If you are located in South Africa, these Terms are governed by the laws of the Republic of South Africa, including the ECT Act, CPA, and POPIA. Disputes shall be subject to the jurisdiction of the South African courts.

If you are located outside South Africa, these Terms are governed by the laws of Northern Ireland, United Kingdom. Disputes shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
